Terms of Service

The rules for using thepulse.fun, The Pulse Rolex Index, the data API and the account dashboard. Short where it can be, specific where it matters.

1. The agreement

These terms are a contract between you and The Pulse ("we"). You accept them by creating an account, using an API key, or using the website. If you use the service on behalf of a company, you confirm you may bind that company, and "you" means the company too. If you do not agree, do not use the service.

2. What the service is

The Pulse publishes The Pulse Rolex Index, per-reference market values derived from confirmed resale sales, a weekly market report, a data API, an account dashboard and a free market game. The index and data are informational. They describe what we observe in the secondary market; they are not an offer, a quote, an appraisal, or a promise that any watch can be bought or sold at any price.

The service is in beta. Coverage (currently 14 Rolex references), endpoints, plans and limits will change as it matures. We will announce breaking API changes with at least 30 days' notice to account holders wherever we reasonably can.

3. Accounts and API keys

  • You must be at least 16 and give a working email address. One account per person or company.
  • Your API keys are secrets. You are responsible for every request made with them, whether or not you authorised it. If a key leaks, revoke it in your dashboard immediately.
  • Do not share one key across unrelated products or customers, and do not resell or sublicense access to the API.
  • We may suspend an account that breaks these terms, abuses the service or has unpaid fees. Where practical we will warn you first.

4. Your license to use the data

While your account is in good standing, we grant you a non-exclusive, revocable, worldwide license to access the data through the API and to display, quote and redistribute it inside your own products, sites, reports and content, on these conditions:

  • Attribution. Wherever our data or the index appears, credit "The Pulse Rolex Index" with a link to thepulse.fun. A short line such as "Data: The Pulse Rolex Index" is enough.
  • Keep the date. Show the as_of date with any value you display. A price without its date misleads people.
  • No passing off. Do not present the index or our values as your own, and do not remove or obscure our attribution.
  • No competing feed. Do not bulk-redistribute the raw data as a standalone dataset or API, and do not use it to build or train a competing pricing index or benchmark.
  • Plan limits. Use the data only within your plan's limits and scope. Sharing keys, rotating accounts or otherwise working around limits ends the license.

We keep all rights not expressly granted, including all rights in the index methodology, the name "The Pulse Rolex Index" and our branding.

5. Acceptable use

Do not: probe, scrape or bypass the API's authentication or rate limits; attempt to access data files directly; interfere with the service or other users; use the service for anything unlawful; or use the data to manipulate a market or deceive anyone. Automated access is welcome through the API with a key; it is not welcome against the website.

6. Plans, billing and cancellation

  • Free. No charge. Limits and scope are described on the pricing page and may change with notice.
  • Developer. Billed monthly in advance through Stripe at the price shown when you subscribe. Your subscription renews automatically until you cancel.
  • Cancel any time from your dashboard. Access continues to the end of the paid period; we do not refund partial months except where the law requires it.
  • Price changes. We will give at least 30 days' notice by email before a price increase takes effect on your plan. Early accounts on a "founding rate" keep that rate while their subscription remains continuously active.
  • Failed payments. If a payment fails we retry and email you; if it stays unpaid the account returns to the Free tier.
  • Enterprise agreements are governed by their own written terms, which take precedence where they differ.

7. Not advice, no guarantees

Nothing on this service is investment, financial, valuation, insurance, tax or legal advice. Watch prices move; past prints do not predict future prices; a value we publish is not a price you will get. Decide for yourself, or with a professional who knows your situation.

We work hard on data quality, but the data comes from third-party marketplaces we do not control, sample sizes are sometimes small, and our screens are not perfect. We publish our methodology and mark thin samples honestly, and we correct errors by published errata rather than by rewriting history. The service is provided "as is" and "as available", without warranties of any kind, including accuracy, completeness, fitness for a purpose or uninterrupted availability.

Trading products described on the site are in development and are not offered by this service. Nothing here is an offer of securities or derivatives.

8. Liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the service or the data. Our total liability to you for all claims in any 12-month period is limited to the fees you paid us in that period, or 100 US dollars if you paid none. Some jurisdictions do not allow these limits; where that is the case they apply only as far as the law permits.

You agree to hold us harmless from claims by third parties that arise from your use of the data in breach of these terms.

9. Ending the agreement

You can stop using the service at any time and ask us to delete your account. We may end or suspend the service, or your access to it, for breach of these terms, for legal reasons, or if we discontinue the service, in which case we will give paying customers at least 30 days' notice and a pro-rata refund of prepaid fees. Sections 4 (attribution obligations for data already published), 7, 8 and 11 survive termination.

10. Changes to these terms

We may update these terms. For material changes we will email account holders at least 14 days before they take effect and update the date at the top of this page. Continuing to use the service after that date means you accept the new terms; if you do not, cancel before they apply.

11. Governing law and contact

These terms are governed by the laws of the place where The Pulse is established, without regard to conflict-of-law rules, and disputes will be brought in the courts of that place. Before going to court, both sides agree to try in good faith to resolve any dispute by writing to each other first.
